Private Residential Tenancies

These are governed by the 2004 Residential Tenancies Act. The Act was introduced to provide strong protection for tenants and to have disputes dealt with by a Private Residential Tenancies Board instead of being dealt with in Court.

Not all residential tenancies come within the scope of the Act. Holiday lettings, business lettings, dwellings where the Landlord also resides or where his/her spouse, parent or children also reside without a written agreement are exempt from the Act.

Private dwellings which are being rented and which are within the scope of the 2004 Act must be registered with the Private Residential Tenancies Board. Since 1st January 2011, the fee for registering is €90. The obligation to register is on the Landlord and registration should be done within one month of the commencement of the tenancy. The fee for late registration is €180.00. If there is a change of Tenant or a change in the rent, the Board must be notified within one month but no further fee is payable.
